By accessing or using the NaijaHome Foods platform ("Platform"), you agree to be bound by these Terms of Use. If you do not agree to all of these terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and NaijaHome Foods Ltd ("Company", "we", "us", or "our").
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of a business or entity, you represent that you have authority to bind that entity to these Terms.
To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Vendors (food sellers) on the Platform must comply with all applicable food safety laws and regulations in Nigeria. Vendors are responsible for the quality, safety, and accuracy of their food listings. NaijaHome Foods reserves the right to remove vendors or menu items that violate our quality standards or these Terms. Vendors receive payment through our secure escrow system, with funds released after confirmed delivery.
Customers may browse vendors, place orders, and make payments through the Platform. All orders are subject to vendor availability and delivery capacity. Prices listed include applicable fees but may exclude delivery charges. Payments are processed securely through our integrated payment partners.
All payments are processed in Nigerian Naira (NGN). We use industry-standard encryption to protect your payment information. Refunds may be issued in cases of order cancellation before preparation, non-delivery, or significantly incorrect orders. Refund requests must be submitted within 24 hours of the scheduled delivery time.
Delivery times are estimates and may vary based on vendor preparation time, traffic conditions, and distance. NaijaHome Foods is not liable for delays caused by circumstances beyond our reasonable control. Customers must be available to receive orders at the provided delivery address.
You retain ownership of any content you submit to the Platform, including reviews and ratings. By submitting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content on the Platform. You agree not to submit content that is defamatory, obscene, infringing, or otherwise unlawful.
You agree not to: (a) use the Platform for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Platform; (c) interfere with the proper working of the Platform; (d) use automated means to access the Platform; (e) harass, abuse, or harm another person through the Platform; (f) submit false or misleading information.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.
To the maximum extent permitted by law, NaijaHome Foods shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
